Notice that the Canaveral Sands 2008 Budget will be discussed

at the November 9th Board of Directors’ Meeting

(This letter also contains other condo information)

 

 

2008 Budget

The Budget Committee and the Board of Directors are recommending the same total budget as last year. The maintenance fee will remain at $420 dollars per unit/per month. The committee chairperson will explain the proposed recommended budget, which is attached to this mailing, at the November 9th Board Meeting and the Board will vote to approve the 2008 budget at this same meeting. 

 

Security Camera

A security camera and related warning sign have been installed on the wall located in the southwest corner of the pool area. 

 

Status of blacktop repair/resurfacing

The concrete inverts (swales) have been installed in front of buildings 1 & 2 to help with water drainage and the asphalt repairs have been completed. The contractor has said he expects to do the asphalt recoating the week of October 29th, weather permitting. It has not been determined if the recoating will be done in 3 or 4 sections. While cars will not be allowed to drive over the fresh recoated areas for 24 hours, residents will be able to walk to their cars from the building within 3 hours of the new coating being applied.   Residents will be given information about the recoating dates as soon as those dates are known.  Owners not residing on the premises may obtain this information by contacting the Management office, during normal business hours, if they plan to visit Canaveral Sands during the timeframe when recoating work is anticipated. 

 

Status of re-keying

The re-keying process started on October 15th as announced in the October Newsletter. The following information is redundant but may be helpful. A synopsis of the re-keying procedure is: (1) each owner will initially receive one new key at no charge, (2) all old keys should be returned to management, (3) Owners returning 3 keys will have them re-keyed at no cost to them (there will be a maximum of 4 keys per unit). Owners not returning 3 keys will have to pay $7 per key to pay for the cost of using blank key stock, (4) Owners will be charged $100 dollars to replace a lost key. Photo identification will be required to pick up key(s).

 

The actual procedure will be:

The date for re-keying of the pool gate, car wash, rec room and beach gates will be November 1st.

One new key will be available to be picked up starting Monday, October 15th.

The initial one key will be available for pick up at the RDI office located at 109 Long Point Road, in Cape Canaveral from 9 a.m. until 4 p.m. weekdays.      Photo identification will be required. Volunteer owners will be available to hand out the initial (1) key in the rec room from 11 a.m. to 12 noon every Saturday and Sunday for a period of 4 weeks starting the weekend of October 20th and 21st.  Photo identification will be required. 

Owners requiring more than (1) key should return up to (3) keys to management to be re-keyed and picked up at a later date.

An owner wishing to have someone other than a deeded owner pick up their new key, must provide the individual with a letter authorizing the Association to give them the key. The individual authorized to pick up the key will be required to present photo identification and will have to sign a receipt for the new key. 

 

The yearly Christmas tree trimming party will be held on Sunday, December 2, 2007, starting at 3:00 p.m.

Bring your own beverage of choice (coffee will be provided) and a snack to share.

Canaveral Sands October 2007 Newsletter

1. Owners may have noticed that some changes in lighting, mostly along the main entrance, have been made because the Association’s 2 large lights, located on FPL poles, had to be turned off to protect the sea turtles.

 

2.  The building 3 roof repairs were finally completed in early September.

 

3. Asphalt repair and recoating

This work will begin around the middle of October. The contractor has said there will not be any restrictions on parking while repairs are being done. There will however, be restricted parking areas during the recoating process.  The contractor has been asked to do the recoating during the week, if possible, because Canaveral Sands is busier on the weekends.  The contractor will try to accommodate this request.  The contractor also said that even when residents are unable to park their cars in the newly coating area, residents will be able to walk to their cars from the building within 3 hours of the new coating being applied.  The date when the recoating will start will be given to residents when it becomes known.

 

4.  Re-keying

5.  Elevator shutdown during hurricanes

The elevators at Canaveral Sands will be shut down 12 hours before a hurricane is predicted to hit near our property. The elevators will be returned to service as soon as the hurricane has passed or as soon as electricity is available. This action is being taken to ensure no one will attempt to use the elevator during a hurricane and become trapped inside it when the electricity goes out.

 

6.  Handbook update

The Canaveral Sands handbook has been updated with the latest general information and the Rules and Regulations of the Association. The committee that volunteered to perform this work has done an excellent job and in a short period of time. The updated handbook has been placed inside each unit. A disk containing the handbook in PDF and Windows format will be sent to Owners who do not permanently reside at Canaveral Sands.  The handbook is also on RDI’s website. Please read the handbook to understand the latest Rules & Regulations and have your renters, guests and visitors read it, also. Current Brevard County flyers on Hurricane Preparedness and Emergency Preparedness for Persons with Disabilities have been inserted in each handbook.

Canaveral Sands June 2007 Newsletter
 

1. Parking
Although Canaveral Sands has more parking capability (garages and open spaces) than most condos, open spaces have become less available over the years. This is especially true on holidays and holiday weekends. As an example there were only a few spaces available during the day on Sunday of the Memorial Day weekend.

A parking committee was formed to look into the present and longer term aspects of parking availability at Canaveral Sands. The committee suggested various solutions, like stickers & tags for vehicles and having a guard at the entrance for holidays and holiday weekends. The Board feels this area requires further investigation before deciding on a solution that affects most residents. For this 4th of July, which is on a Wednesday, the north entrance will be blocked off from Saturday June 30 to Monday July 9. This eliminates the entrance next to the public beach walkway, leaving only the main entrance. The north entrance has been blocked the last three July 4ths and has minimized non-visitors/guests from using our parking spots. The committee will monitor parking over this time to determine if more severe action will be required in the future

The Board at the June Board meeting made a motion not to allow parking of RV’s trailers, boats and other watercraft on the premises on holidays and holiday weekends so more parking would be available for cars. Of course any of these can be put in your garage.

2. Building 3 roof repairs
The repairs are quite extensive and the cost will be $87,000. A contractor has been selected. The contractor has said he can start the week of June 18. It is expected the repairs will be completed before the major part of the hurricane season arrives. The association has given the contractor permission to work on Saturday to get the repairs done as soon as possible.

3. Handbook update
The Canaveral Sands handbook has been updated with the latest general information and the rules & regulations of the association. The committee that did this has done an excellent job in a short period of time. The handbook is presently in printing and will be placed in each unit, along with a small disk, in the near future. The handbook is on the disk in PDF and Windows format. The handbook will also be on RDI’s website. Please read the handbook to understand the latest rules & regulations and have your renters, guests and visitors read it also. Current county flyers on Hurricane Preparedness and Emergency Preparedness for Persons with Disabilities will be inserted in each handbook.

4. Mold
Mold is a problem that is created under humid conditions. It is the owners responsibly not to allow mold to start and to remove mold from their unit once it is there, whether the cause is due to inclement weather or irresponsible acts of the owner/resident. Mold can spread from unit to unit. Owner’s who allow mold to start in their unit are responsible for the cost of removing that mold and are also responsible for mold that spreads to other units. Owners should keep their AC’s in working order and keep them on at a temperature no higher than 80 degrees when they are gone to keep mold from occurring.

5 Keys to rec room and pool & ocean gates
The Board has decided to replace the key to the rec room and the pool & ocean gates. It is felt that over the years many keys have found their way into the hands of people that should not have them. This will be done after the summer. The replacement procedure will be explained in a later newsletter.

6. Greeting Committee
A greeting committee has been formed to meet with new owners and renters. The Committee will welcome them to Canaveral Sands and tell them we want their stay here to be pleasant and enjoyable. They also want to make sure everyone understands the rules and regulations of this condominium. Owners please make sure your renter fills out our new renter form and reads the handbook in each unit

7. Lighting at main entrance
The lighting at the main entrance and some of our stairwells may and be changing soon. The City may make us do it because they say our present lighting affects the sea turtles. The President and Management are presently working with the city on this. Last year they made us turn off the large light on the FPL pole by garage D.

Rules and Regulations--Infractions & Enforcement

The April 13 workshop minutes on this subject is attached. The 7 step rule, infraction identification, notification and enforcement procedure identified on the second page of the attached workshop minutes follows the recommendation of the association’s attorney (a letter from the association attorney on this subject is also attached). The Board has taken the 1st step by making a strongly worded rule at the April Board meeting (below) that owners are required to notify the association who is occupying their unit and by identifying the enforcement procedure used when rules and regulations are broken. The 2nd step in the procedure is this newsletter sent to all owners identifying the rule and the enforcement procedure. The 3rd step has also been completed, which is generating standard forms for owners to fill out identifying who will be residing in their unit and or guests & friends using our facilities. A committee has completed these identification forms and they are also attached. They are the “owner profile form” and the “rental/lessee/guest form”. It is expected present owners will fill out the “OWNER’S PROFILE FORM” and send it back to Management in the enclosed self addressed envelope so we have complete accurate information as to the owners residing at Canaveral Sands, both permanent and part time. A second committee will greet new owners and renters: this committee could use a few more volunteers. Please read the attached workshop minutes to understand the association’s position and your responsibility in regard to this subject.

The forms include owner and renter automobile information. It is important this information be supplied. The association is looking into a method of vehicle identification for owner and renter automobiles. There is a possibility that only owner and renter automobiles will be allowed to park in front of the 4 buildings. Visitors would be required to park elsewhere on the premises.

The following motion information is taken from the April Board Meeting Minutes:
Jerry Burke made a motion that everyone residing at Canaveral Sands must be identified to the association. Residency identification forms will be available through Management and must be returned completely filled out to Management.
1. The owner(s) and any other person(s) that will be permanently or periodically residing in the unit must be identified when the unit is bought and any time later if the persons residing in the unit should change.
2. The owner has the responsibility of identifying person(s) residing in their unit during 30 days or more rentals.
3. The owner has the responsibility of identifying relatives and guests that will be residing in their unit for less than 30 days, while the owner is not present.
The motion further states that the owner is responsible for the conduct of their guests not residing in their unit that are using Canaveral Sands facilities. The motion was seconded by Ed Smally. All in favor.

Enforcement of Canaveral Sands rules & regulations infractions will follow the normal procedure. The first 2 violations will result in to letters to the owner identifying the infraction and notification that the association expects the infraction to stop or not to occur again. The 3rd infraction will result in a letter from the association attorney. The 4th infraction will result in the start of legal action.

This newsletter was deemed necessary because of a situation at Canaveral Sands that has become increasingly worse over the years but became especially bad the summer of 2006. Canaveral Sands was inundated with persons and families that came to Canaveral Sands and behaved as though they were visiting a resort, hotel or motel. There were many abuses to the property. Many of the rules were ignored and people breaking the rules were very rude when this was mentioned to them, and they continued to break the rules. These persons and families include renters, guests & friends of renters and guests & friends of owners. There may even have been some owners involved. There was one group of families with many children that rented 6 units for the month of July.

Canaveral Sands has become more popular as a vacation place probably in part because of its large pool and it’s proximity to the ocean. Last year, there were numerous complaints from owner residents that non-owner residents were creating a nuisance by not obeying condo rules and lacking the civility and common courtesy one has come to expect at Canaveral Sands. This problem has become increasingly worse over the years with the summer of 2006 being the worse by far, resulting in a large number of complaints to Management.

A newsletter was sent out last August on the subject mentioning the problem and asking for inputs from owners. The Board, after reviewing owner inputs, decided to have a workshop before the 2007 summer to discuss the situation and attempt a resolution. The association has received advice from our attorney regarding what legally can be done to resolve this situation. The Board and Management are willing to do their part but it will become obvious to workshop attendees that no resolution is possible without the cooperation and active participation by owners. Participation by owners at the workshop and after the workshop is a necessary part of any solution for this situation.

Some but not all of the complaints received by Management are mentioned below:

·   Children running on walkways

·   Residents hollering to each other from building to building and from walkways to and from the ground.

·   People in cars honking car horns for residents to come out

·   Climbing over the gate to the ocean

·   Children playing in the elevator—e.g. pushing all the buttons and riding it up and down or holding it on one floor for long periods of time.

·   Children using the parking lot for a playground—inhibits traffic and cars have been hit by objects—liability for the association

·   Confrontations between unit owners and non-unit owners

·   Too many people occupying a unit

·   Hanging towels over railings

·   Leaving items on walkways for long periods of time, including overnight

·   Pizza boxes, Pizza boxes—they do not slide down the garbage chute.

·   Extremely noisy in  pool area

·   Not closing pool gate

·   Using pool after hours

·   Small children left unattended in pool area

·   Food and drink brought into pool area

·   Running games played around the pool

·   Adults have complained that they could not use pool because it was full of children or children were playing games

·   Boats parked on premises without permission

The Board, Management and a small number of owners at Canaveral Sands have spent considerable time and effort working on improving management services, the financial situation and the landscaping to make Canaveral Sands a pleasant place to live as well as replacing/repairing the physical part of the property when necessary to maintain/increase the property values. Canaveral Sands at the present time has the reputation of being pleasant to look at, being well maintained and having a pleasant home type living atmosphere. All residents (owners and renters) should be able to expect a friendly home type atmosphere while residing here. Management and the Board cannot solve the problem mentioned in this Newsletter without the help of owners. It is time for all unit owners to do their part. Owners should be aware that they are responsible for the actions of renters, friends and guests using their unit.

The 1st workshop will be held April 13, 2007, at 6:30 PM, in the rec room.   Attend if you want this situation to be resolved.

PS: The problem described above cannot be resolved this year without active participation by owners at the workshop(s) and during the summer. Owners should not expect the Board and Management by themselves to resolve this situation for you. It is not possible. Apathy and the common practice of condo owners to let the other person do it will end up with the same result as only getting 59 votes (69 were needed) to change the condo documents so it would not be necessary to send the 1st notice of the membership meeting via certified mail with return receipt. That is, nothing will be done to resolve the situation. In that case it has to be assumed that is what most of the owners want.

 It is important that owners sign and send in their proxies for the following 3 reasons:

·    A membership meeting cannot be held unless 51% of the members attend either in person or by sending in a proxy.

·    A new Board of Directors cannot be elected if it is not possible to hold a members meeting.

·    A positive vote of 2/3 of the total membership is required to change our documents so the 1st meeting notice of the annual membership meeting will not require being sent via certified mail with return receipt. This year the certified mail requirement cost the association $501.50 more than a regular mailing. This extra certified mailing cost will continue every year unless 2/3 of our members vote to change our document as shown in this mailing. Don’t forget to send in your proxy with a vote for this important amendment change.

 

There are now 7 owner applicants for the 5 Board of Directors positions. The present board feels this is a healthy situation when owners are willing to spend their time and effort to contribute to the well being of Canaveral Sands. Although much has been done in the last few years much will always continue to be required because of the age of the buildings and the large property area. It is obvious that our buildings being 22 to 26 years old now need continuous repairs/replacement to keep the buildings and grounds in a livable and pleasant looking condition. The items below show some, but not all, of the items involved in keeping Canaveral Sands Condominium in good condition and a pleasant place to live.

 

Items of interest since last annual meeting:

·    Management, The President and our Maintenance Person (Phil) developed permanent specifications for the new maintenance person to be hired. They also held many meetings with applicants before hiring Richard Keinenan

·    Rich Keinenan was hired in June to replace Phil Heller as our permanent maintenance person because Phil previously told the association he wanted to retire from full time work but would be willing to work part time. Phil replaces Rich when necessary. He also works 2 days a week. Performing tasks that would normally be performed by contractors, thus saving the association money. This also allows Phil’s extensive knowledge of the association’s infrastructure to be available to the association.

·    Condo insurance increased substantially, causing a $600 special assessment and a condo fee increase

·    Lights on premises are causing a problem for turtles according to the city

·    Replaced firm that cut the dunes a 2nd time. It has been hard to get dunes cut the way we want them cut. They seem to be trimmed correctly by this firm.

·    Replaced buildings 1 and 2 walkway railings

·    Fire hydrant valves for building 1 & 2 were replaced. In addition the large red backflow valves at an unexpected cost of $19,000 were also required by inspectors.

·    Hand control of irrigation zones was installed

·    Replaced elevator maintenance firm

·    Replaced elevator door detectors all elevators

·    Replaced elevator doors and door hardware

·    Eight elevator doors were raised and cement work done so rainwater would not run down elevator shafts

·    Replaced 2 irrigation wells at North end of property with one deeper well

·    Building 3 was painted

·    Replaced pool heater

·    Pool fence painted

·    All 1st floor walkways painted

·    Replaced sliding glass doors in rec room

·    Painted rec room and replaced lights in rec room

·    Put “Y” AC cleanouts in 1st floor units xxx3 & xxx4

·    Planted 3 tall palm trees on the South ed of our property

·    Planted a 3 trunk Christmas palm between north end of garage C and street

·    Paver paths put in & landscaping done between buildings 1 & 2 where backflow valves were installed

·    Minor cement repairs made to many garages and buildings

·    Replaced main electrical circuit breaker in building 1.

·    There was a problem in July with non-owner residents not following condo rules. A workshop will be held on this subject in the first part of 2007.

·    Fire alarm covers were installed on the pull stations in all buildings.

·    The beautiful sago palms on our property are dying. They are dying all over Florida. Steps are being taken to save them but there is not much hope.

·    An amendment proposal to our documents to eliminate the requirement to send the 1st notice of our membership meeting via registered mail with returned signed receipt was sent to the membership for a vote.

 

Items of interest in the near future (an* indicates the item is expected to be done in 2007)

·    Paint building 4-- minor repairs to building will be done before painting*

·    Paint garages-- minor repairs will be done before painting*

·    Paint garage doors-- minor repairs will be done before painting

·    Replace the rest  (7) of the trash chute doors*

·    Blacktop resurfacing with some blacktop replaced to improve drainage*

·    Garage roofs B, D, and E will have to be replaced in an estimated 1 to 3 years

·    Building 3 roof will have to be replaced in an estimated 2 to 5 years

·    Both gates to ocean will be replaced*

·    The South and East perimeter fence will have to be replaced in an estimated 2 to 3 years

·    Protection for elevator frame edges will be installed*

·    Elevator repairs/replacement for pumping units/control valves/cables/etc. will be required in an estimated 2-5 years according to our elevator consultant. This will be a major expense, so the elevator reserve should be built up to eliminate or minimize a special assessment.

·    The county environmental heath department wrote the Association a pool a violation for not having a 2 inch stripe across the pool bottom and up the sides where the deep end starts. This will have to be installed when the pool is refurbished

·    Main entrance lighting may have to be altered next turtle season. The board has looked into alternatives.*

·    The fire alarm inspection from the city noted that we need a fire alarm monitoring system. This will require something from our fire alarm control panels that will send signals to a monitoring company.* This could be expensive and may lead to even more expensive upgrading requirements by the city.

·    Finish installing fiberglass doors on all entrance doors*

·    Workshop(s) will be held to attempt to resolve a summer rental situation that has developed where many renters do not follow condo rules and regulations, resulting in unsanitary, unpleasant, and dangerous conditions on Canaveral Sands property
